Terms & Conditions

1. Who you are contracting with

These terms govern your use of SPANA, operated by SPANA (Pty) Ltd (“SPANA”, “we”, “our”, “us”), a company based in South Africa. By using the SPANA app, website or services you (“user”, “customer”, “provider”) agree to these terms.

2. What SPANA does

SPANA is an online marketplace that connects customers with independent service providers (mechanics, plumbers, nurses, tutors and more). SPANA is not the provider of the services listed on the platform. The contract for the actual job is between the customer and the provider.

3. Acceptable use

You must not: use the service unlawfully, post fraudulent or spam content, infringe intellectual-property rights, scrape data, distribute malware, or attempt to interfere with the platform’s security.

4. Account & accuracy

You must keep your login credentials confidential. You are responsible for all activity under your account. You agree to provide accurate registration information and keep it up to date.

5. Request fee (paid by the customer)

When a customer hires a provider through SPANA, the customer pays SPANA a request fee to deploy that provider. The provider never pays SPANA. The fee depends on the distance between customer and provider:

  • ≤ 30 km — flat tier (e.g. R200 / $11 / ¥80)
  • ≤ 50 km — flat tier (e.g. R400 / $22 / ¥160)
  • > 50 km — the provider sends a fee offer; if the customer accepts, the customer pays that amount to SPANA

The work fee (the price of the actual job) is agreed directly between the customer and the provider. SPANA does not collect, hold, or take a commission on the work fee — it is a separate matter between the two parties.

6. Payments & processing

Payments on SPANA are processed by Paystack Payments (Pty) Ltd ("Paystack") on behalf of SPANA (Pty) Ltd. Paystack securely handles card, EFT and mobile money transactions. By paying, you also agree to Paystack's Terms of Service. Refunds are handled according to our Refund Policy.

7. Intellectual property

SPANA retains ownership of the platform, software, branding, documentation and any improvements. You receive a limited, non-exclusive, non-transferable right to use the platform.

8. Service level & disclaimers

The service is provided “as is”. We do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties.

9. Suspension & termination

We may suspend or terminate access for material breach, non-payment of provider request fees, security or fraud risk, or repeated policy violations (including the SPANA 3 complaints in 6 months provider-block rule).

10. Liability

Our aggregate liability is capped at fees paid to SPANA in the prior 12 months. We exclude liability for indirect, consequential or special damages, except where law forbids exclusion.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the courts of South Africa.
